The Kidnap Kingpin and his accomplices committed the offence of conspiracy at 7.45 p.m. on February 14 at Obokun Street, Ilupeju, Lagos, the prosecution stated.
They were armed and their operation led to the capture and detention of Mr. Duru Donatus.
The defendants were also accused of collecting a ransom of €223,000 before Donatus was released.
The defendants changed their plea after the re-amended charge was read to them yesterday in court.
Initially charged under Sections 411 and 271(3) Criminal Law Cap C17 Laws of Lagos State 2015,the defendants are now being charged under Section 2(1) of the Kidnapping Prohibition Law, No 13, Laws of Lagos State 2017.
The Kidnapping Prohibition Law, No 13, Laws of Lagos State 2017 prescribes a death sentence if victims die in the custody of kidnappers.
It is this variant in punishment that may have caused the Defendants to change their pleas.
But the defence counsel, Messrs Olukoya Ogungbeje, Joseph Otogblu and A.A. Ozogbu opposed the prosecution, saying that the prosecution had served them the amended charges just as they got to Court yesterday.
They prayed that the case be adjourned so they may confer with their clients on the matter.
However the prosecution argued that there was no need for that as the other charges where still before the Court.
Justice Oshodi after reviewing arguments and pending applications struck out the pleas of the Defense.
He however granted their prayers and adjourned the matter till November 3, 2017, for trial.
